Please read these Terms of Service ("Terms") carefully before using FlowTrack Pro ("Service"), operated by FlowTrack Pro LLC ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Description of Service

FlowTrack Pro is a multi-tenant software-as-a-service (SaaS) platform designed for backflow prevention testing companies. The Service provides tools for managing backflow prevention devices, test records, scheduling, customer communications, and city compliance form submissions.

FlowTrack Pro is a management tool only. We are not a certified backflow testing service and do not perform, certify, or guarantee any backflow prevention testing. All testing must be performed by appropriately licensed and certified professionals.

2. Account Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the organization you represent.

3. Subscription Plans and Pricing

FlowTrack Pro offers the following subscription tiers:

Starter — $99 per month
Professional — $249 per month
Enterprise — $499 per month

All new accounts receive a 14-day free trial with full access to the Service. No payment information is required to start a trial. At the end of the trial period, you must select a subscription plan to continue using the Service.

Pricing is subject to change with 30 days' written notice. Changes to pricing will take effect at the start of your next billing cycle following the notice period.

4. Payment Terms

All payments are processed securely through Stripe. By subscribing to a paid plan, you agree to the following:

Subscriptions are billed monthly in advance on the anniversary of your subscription start date
All fees are quoted in U.S. dollars and are non-refundable except as required by law
You authorize us to charge your payment method on file for all applicable fees
Failed payments may result in suspension or termination of your account

You may upgrade or downgrade your subscription plan at any time. Changes take effect at the start of your next billing cycle.

5. User Responsibilities

You are solely responsible for:

The accuracy, completeness, and legality of all data entered into the Service, including test results, device information, and customer records
Compliance with all applicable federal, state, and local regulations governing backflow prevention testing and reporting
Ensuring that all users within your organization are trained on proper use of the Service
Maintaining current backflow tester certifications and licenses as required by your jurisdiction

Data accuracy is your responsibility. FlowTrack Pro does not verify the accuracy of test data, device information, or compliance forms submitted through the platform. You are responsible for ensuring all data and reports are correct before submission to any regulatory authority.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Submit false, misleading, or fraudulent data through the Service
Attempt to gain unauthorized access to any part of the Service or its related systems
Interfere with or disrupt the integrity or performance of the Service
Reverse engineer, decompile, or disassemble any aspect of the Service
Resell, sublicense, or redistribute the Service without prior written consent
Use the Service to transmit spam, malware, or other harmful content

7. Intellectual Property

The Service, including its software, design, logos, and documentation, is the exclusive property of FlowTrack Pro LLC and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any ownership rights in the Service.

You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you.

8. Data and Privacy

We take the security and privacy of your data seriously. Our handling of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We implement commercially reasonable security measures to protect your data. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

Scheduled maintenance (we will provide reasonable advance notice when possible)
Emergency maintenance or security patches
Circumstances beyond our reasonable control, including third-party service outages

10. Account Suspension and Termination

Termination by you: You may cancel your subscription at any time through your account settings or by contacting support@flowtrackpro.net. Cancellation takes effect at the end of your current billing cycle. No refunds are issued for partial billing periods.

Termination by us: We may suspend or terminate your account immediately, without prior notice, if:

You violate these Terms or any applicable laws
Your payment method fails and is not updated within 14 days
Your use of the Service poses a security risk or may harm other users
We are required to do so by law

Effect of termination: Upon termination, your right to access the Service ceases immediately. We will retain your data for 30 days following termination, during which time you may request an export. After 30 days, your data will be permanently deleted.

11. Limitation of Liability

To the maximum extent permitted by applicable law, FlowTrack Pro LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of or inability to use the Service.

In no event shall our total aggregate liability to you for all claims arising out of or related to these Terms or the Service exceed the total amount paid by you to us during the twelve (12) months immediately preceding the event giving rise to the claim.

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Indemnification

You agree to indemnify, defend, and hold harmless FlowTrack Pro LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service
Your violation of these Terms
Your violation of any applicable law or regulation
Any data or content you submit through the Service

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and, where practicable, by email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in California.

15. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and FlowTrack Pro LLC regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
Force Majeure: We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control.
